Terms of Service

These terms cover the hosted OpenBrainStore service at openbrainstore.com. (Running the source-available server yourself is governed by its license, not these terms.) Using the hosted service means you accept them.

The service

OpenBrainStore stores and retrieves memories — text you or your AI clients deliberately save — scoped to your GitHub identity, over the Model Context Protocol. You need a GitHub account to sign in, and you must be legally able to enter this agreement.

Your data is yours

You own everything you store. We claim no rights over your memory content beyond what's needed to operate the service (storing it, indexing it, computing embeddings on our own server, backing it up). Export is available at any time via the export tool; deletion via forget and the process in our privacy policy.

Acceptable use

Don't use the service to store or distribute content that is illegal, that infringes others' rights, or that you don't have the right to hold. Don't probe, overload, or attempt to break tenant isolation, and don't resell access to the hosted service. Rate and storage limits exist to keep the service healthy; deliberately evading them is a breach of these terms.

Plans, billing, cancellation

Beta honesty clause

The hosted service is early. We run nightly off-site backups and test restores, but we are one small operation: keep your own exports of anything you cannot afford to lose. The service is provided "as is" and "as available," without warranties of uninterrupted operation or fitness for a particular purpose.

Liability

To the maximum extent the law allows, our total liability for any claim arising from the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost data where our backup and export mechanisms functioned as described.

Termination

You can stop using the service (and delete your data) at any time. We may suspend or terminate accounts that breach these terms, with notice where practical; you'll have the opportunity to export your data unless the content itself is unlawful to return.

Changes

If these terms change materially, the effective date above changes and active subscribers get an email before the change applies. Continuing to use the service after that is acceptance.
